Autentická genderová identita a problematika transgenderu: Lidství je víc než pohlavní identita

Abstract

Humanity is more than sexual identity The dissertation comprehensively addresses the topic of authentic gender identity and the issues faced by transgender individuals in contemporary society. It interconnects biological, medical, philosophical, ethical, and legal aspects of gender identity and analyzes their mutual relationships. The starting point is a phenomenological approach, which enables a deeper understanding of gender as a way of being in the world, rather than merely a social role or biological given. The work reflects recent legislative changes in the Czech Republic that allow for official gender change without the requirement of surgical intervention and analyzes their impact on the rights and dignity of transgender individuals. Special attention is devoted to bioethical principles of beneficence, nonmaleficence, autonomy, justice, and the best interests of the child in the context of care for transgender children and adolescents. The dissertation critically evaluates the gender-affirmative care model, highlights the risks of detransition, and calls for a multidisciplinary, cautious, and individually tailored approach. Lidství je víc než pohlavní identita Disertační práce se komplexně zabývá tématem autentické genderové identity a problematikou transgender osob v současné společnosti. Práce propojuje biologické, medicínské, filosofické, etické a právní aspekty genderové identity a analyzuje jejich vzájemné souvislosti. Východiskem je fenomenologický přístup, který umožňuje hlubší porozumění genderu jako způsobu bytí ve světě, nikoli pouze jako sociální role či biologické danosti. Práce reflektuje aktuální legislativní změny v České republice, které umožňují úřední změnu pohlaví bez nutnosti chirurgického zákroku, a analyzuje jejich dopady na práva a důstojnost transgender osob. Zvláštní pozornost je věnována bioetickým principům beneficence, nonmaleficence, autonomie, spravedlnosti a nejlepšího zájmu dítěte v kontextu péče o transgender děti a adolescenty. Práce kriticky hodnotí genderově afirmativní model péče, upozorňuje na rizika detranzice a volá po multidisciplinárním, opatrném a individuálně zaměřeném přístupu.
