Surrogacy, Human dignity, Best interest of the childNáhradní mateřství Abstrakt Tato diplomová práce se zabývá problematikou náhradního mateřství jako jedné z nejkontroverznějších forem asistované reprodukce, která v současné společnosti vyvolává závažné etické, sociální a právní otázky. Rozvoj reprodukčních technologií umožnil vznik nových forem rodičovství, současně však otevřel prostor pro konflikty mezi individuálními reprodukčními přáními dospělých a ochranou základních práv osob, které jsou do procesu náhradního mateřství zapojeny, zejména dětí a náhradních matek. Cílem práce je prostřednictvím komparativní analýzy právní regulace náhradního mateřství v České republice a Chorvatsku posoudit, do jaké míry jednotlivé právní přístupy zajišťují systémovou ochranu práv a zájmů osob účastnících se procesu náhradního mateřství. Pozornost je věnována především ochraně nejlepšího zájmu dítěte, lidské důstojnosti a otázce možného vykořisťování žen v postavení náhradních matek. Práce nejprve analyzuje eticko-sociální rizika spojená s náhradním mateřstvím, zejména problematiku komodifikace lidské reprodukce, strukturální nerovnosti, které mohou ovlivňovat skutečnou autonomii náhradních matek, oslabení právní jistoty dětí narozených z náhradního mateřství a jejich práva na znalost vlastního původu a identity. Surrogacy Abstract This diploma thesis addresses the issue of surrogacy as one of the most controversial forms of assisted reproduction, which raises significant ethical, social, and legal concerns in contemporary society. The development of reproductive technologies has enabled the emergence of new forms of parenthood; at the same time, however, it has created tensions between the individual reproductive desires of adults and the protection of the fundamental rights of persons involved in the surrogacy process, particularly children and surrogate mothers. The aim of the thesis is to assess, through a comparative analysis of the legal regulation of surrogacy in the Czech Republic and Croatia, the extent to which different legal approaches ensure systematic protection of the rights and interests of persons participating in the surrogacy process. Particular attention is paid to the protection of the best interests of the child, human dignity, and the risk of potential exploitation of women in the position of surrogate mothers.
