Abstract

The Evolution of the Doctor Patient Relationship in the Context of Therapeutic Privilege Abstract The thesis deals with the development of the doctor patient relationship in the context of therapeutic privilege, that is, the possibility for a doctor temporarily to withhold adverse information about the diagnosis or prognosis of the state of health in the patient's interest. The theoretical part first reconstructs the transformation of the doctor patient relationship from the traditional paternalistic model, based on the principles of beneficence and non-maleficence, to the current model in which the principle of respect for the patient's autonomy and the doctrine of informed consent prevail. Special attention is paid to the development of these concepts and to the importance of the European Convention on Bioethics for the transformation of the doctor patient relationship in the Czech environment. Against this background, the main sources of legal regulation are systematically presented, in particular the European Convention on Bioethics, the Health Services Act and the Civil Code, and their impact on the concept of informed consent and the physician's duty to inform in terms of truthfulness, scope and timing of the information provided. Vývoj vztahu lékař pacient v kontextu terapeutického privilegia Abstrakt Diplomová práce se zabývá vývojem vztahu lékaře a pacienta v kontextu institutu terapeutického privilegia, tedy možnosti lékaře dočasně zadržet nepříznivou informaci o diagnóze či prognóze zdravotního stavu ve prospěch pacienta. Teoretická část nejprve rekonstruuje proměnu vztahu lékař pacient od tradičního paternalistického modelu, založeného na principu beneficence a non-maleficence, k současnému modelu, v němž dominuje princip respektu k autonomii pacienta a doktrína informovaného souhlasu. Zvláštní pozornost je věnována vývoji těchto konceptů a důležitosti Úmluvy o biomedicíně pro transformaci vztahu lékař pacient v českém prostředí. Na tomto pozadí jsou systematicky představeny hlavní prameny právní úpravy, zejména Úmluva o lidských právech a biomedicíně, zákon o zdravotních službách a občanský zákoník, a jejich dopady na pojetí informovaného souhlasu a informační povinnosti lékaře z hlediska pravdivosti, rozsahu a načasování poučení. Stěžejní část práce je zaměřena na terapeutické privilegium, jeho vymezení, etická východiska a napětí mezi respektem k autonomii pacienta, požadavkem pravdivosti poučení a přetrvávajícími paternalistickými tendencemi.
