Abstract

The Child's Right to Contact with Grandparents Abstract The thesis examines the child's right to contact with grandparents and its incorporation into the legal order of the Czech Republic. Its aim is to analyze the legal regulation of the child's right to contact with grandparents in the Czech Republic, including references to legal provisions that have been repealed. The practical part of the thesis focuses on case law of selected district and regional courts concerning the regulation of a child's contact with grandparents. The first part addresse the historical development of the position of the child and grandparents in law and society. In this context, the child's right to contact with grandparents and its regulation under repealed legal provisions are discussed. The second part outlines the current legal regulation, including a chapter defining the concept of grandparenthood, the legal status of grandparents, and the child's position in law. The regulation of a child's contact with grandparents is first presented at the constitutional level, through relevant provisions of the Charter of Fundamental Rights and Freedoms and the Convention on the Rights of the Child. Právo dítěte na styk s prarodiči Abstrakt Diplomová práce se zabývá právem dítěte na styk s prarodiči a jeho zakotvením v právním řádu České republiky. Cílem práce je analyzovat právní úpravu práva dítěte na styk s prarodiči v České republice, a to s přesahem do již neúčinných právních předpisů. Praktická část diplomové práce se zaměřuje na rozhodovací praxi vybraných okresních a krajských soudů ve věcech úpravy styku dítěte s prarodiči. Nejprve je prostor věnován historickému vývoji postavení dítěte a prarodičů v právu i ve společnosti. V této souvislosti je pojednáno o právu dítěte na styk s prarodiči a jeho úpravě v již neúčinných právních předpisech. Ve druhé části je vymezena platná právní úprava, přičemž je zahrnuta kapitola věnovaná vymezení pojmu prarodičovství, osobám prarodičů a rovněž dítěti a jeho právnímu postavení. Platná právní úprava styku dítěte s prarodiči je nejprve představena v ústavní rovině prostřednictvím relevantních ustanovení Listiny základních práv a svobod a Úmluvy o právech dítěte. Následuje úprava obsažená v občanském zákoníku, a to zejména ust. § 927 obč. zák. Závěr druhé části tvoří stručné shrnutí relevantní právní úpravy obsažené v dalších mezinárodních úmluvách, kterými jsou Úmluva o styku s dětmi a Evropská úmluva o výkonu práv dětí.
