"Výchova za mřížemi": Právní aspekty ústavní a ochranné výchovy nezletilých dívek a dívek-matek a postoje personálu k nim

Abstract

The thesis addresses the issue of institutional and protective care for underage girls, pregnant girls, or mothers who have been placed in a residential care institution based on a court decision. The work draws on the valid laws and rights that govern institutional facilities in the Czech Republic. In the theoretical part, I examine the legal norms, the Act on Institutional and Protective Care, and the professional roles involved in the functioning of such facilities. I also clarify the key concepts necessary for the empirical part of the thesis. In the empirical section, I will conduct interviews with employees who hold different perspectives, job roles, and positionalities (social worker, psychologist, special educator, director of the institution, head educator). In addition, I would like to explore the position of the public prosecutor responsible for the facility. The main aim of this thesis is to provide a deeper understanding of the attitudes and views of professionals who are key actors in working with underage girls and underage mothers placed under institutional or protective care. The findings may contribute to improving or modifying the work carried out with this group of young people. Key words: institutional care, underage mothers, girls' criminality, rights of the child

Práce se zabývá problematikou ústavní a ochranné výchovy pro nezletilé dívky, těhotné nebo matky, které byly na základě soudního rozhodnutí umístěny do výchovného ústavu. V práci vycházím z platných zákonu a práv, kterými se ústavní zařízení v České republice řídí. V teoretické části práce projdu právní normy, zákon o ústavní a ochranné výchově a pracovní složky, které do fungování zařízení spadají. Také rozeberu základní pojmy nezbytné pro empirickou část práce. V empirické části práce provedu rozhovory se zaměstnanci/kyněmi s odlišnou perspektivou, náplní práce a pozicionalitou (sociální pracovnice, psycholožka, etopedka, ředitel zařízení, vedoucí vychovatel). Současně bych také chtěla zkoumat postoj státního zástupce v zařízení. Hlavním cílem této práce je poskytnout hlubší porozumění postojům a názorům profesionálů/el, kteří/ré jsou klíčovými aktéry v práci s nezletilými dívkami, dívkami-matkami s nařízenou ústavní nebo ochrannou výchovou. Výsledky by mohly přispět ke zlepšení nebo úpravě práce s touto skupinou mladistvých. Klíčová slova: ústavní výchova, nezletilé matky, kriminalita dívek, práva dětí
