Watching the Watchers: Ethical and Legal Boundaries of Modern Surveillance

Abstract

Surveillance has great significance in today's world. It interferes with people's lives on a daily basis through things like CCTV cameras, targeted marketing and many other ways of data collecting and processing. Surveillance used as a tool of the public sector to fulfil their responsibilities was also part of the privatisation and delegation of duties to the private sector. Public-private partnerships are among the most prominent mechanisms for long term delegation and cooperation in the surveillance sector. This thesis investigates, on one hand, the benefits of surveillance and on the other the ethical and legal boundaries of surveillance both within and out of the public-private-partnership framework. It analyses the legal frameworks of two cases, the European Union and the United States of America. The analysis finds that even though the US legal framework has most important sectors covered, it comes up short in comparison to the comprehensive legal norms governing surveillance in the EU.

Sledování má v dnešním světě velký význam. Ovlivňuje každodenní život lidí prostřednictvím kamerových systémů, cíleného marketingu a mnoha dalších způsobů shromažďování a zpracování dat. Sledování používané jako nástroj veřejného sektoru k plnění jeho povinností bylo také součástí privatizace a delegování povinností na soukromý sektor. Partnerství veřejného a soukromého sektoru patří mezi nejvýznamnější mechanismy dlouhodobého delegování a spolupráce v oblasti sledování. Tato práce zkoumá na jedné straně výhody sledování a na druhé straně etické a právní hranice sledování jak v rámci partnerství veřejného a soukromého sektoru, tak mimo něj. Analyzuje právní rámce dvou případů, Evropské unie a Spojených států amerických. Analýza zjistila, že i když právní rámec USA pokrývá nejdůležitější sektory, v porovnání s komplexními právními normami upravujícími sledování v EU je nedostatečný.
