form of government - constitution - CzechoslovakiaTato diplomová práce analyzuje proměny postavení a vzájemných vztahů mezi vrcholnými státními orgány v Československu v období vlády Komunistické strany a zároveň identifikuje typy formy vlády ve všech jeho etapách a rovinách řízení založených na ucelené ústavní úpravě. Cílem je zodpovědět, zda změny v jednotlivých uspořádáních vedly k nahrazení parlamentní formy vlády systémem vlády shromáždění. V první části práce definujeme termín forma vlády, odlišujeme ho od jiných pojmů a členíme na dílčí typy - prezidialismus, parlamentarismus, poloprezidialismus a vládu shromáždění. Ty pak detailně rozebíráme na základě respektované politologické a státovědné literatury i analýzy režimů všeobecně uznávaných jako vzory každého typu. Ze získaných informací sestavujeme klasifikaci zahrnující sedm rozhodných znaků a jednu interpretační pomůcku, díky nimž lze jakékoli ústavní zřízení univerzálně podřadit pod některou formu vlády. Druhá, třetí a čtvrtá část naší práce se postupně věnují konkrétním státoprávním uspořádáním v Československu vytvořeným ústavami z let 1948, 1960 a ústavním zákonem o československé federaci z roku 1968 a s ním souvisejícími předpisy. Nejprve každou úpravu uvádíme do kontextu historického i ideového, načež vytyčujeme její ucelené úrovně a relevantní orgány, tedy parlament, hlavu státu...
This diploma thesis analyses the changes in the position and mutual relations between the highest state authorities in Czechoslovakia during the Communist Party's rule and identifies the types of the form of government in all its periods and levels of governance based on comprehensive constitutional layout. The aim is to answer whether the changes in individual arrangements led to the replacement of the parliamentarism with the system of assembly government. In the first part of the thesis, we define the term form of government, distinguish it from other concepts, and divide it into the sub-types - presidentialism, parliamentarism, semi-presidentialism, and assembly government. We then analyse these in detail on the basis of respected political and state science literature and analyses of countries generally recognized as examples of their types. From the information obtained, we compile a classification comprising seven key characteristics and one interpretative aid, thanks to which any constitutional system can be universally classified under a particular form of government. The second, third, and fourth parts of our thesis step by step focus on specific constitutional layout in Czechoslovakia created by the constitutions of 1948 and 1960 and the constitutional law on the Czechoslovak Federation...
