Zastřené agenturní zaměstnávání a nelegální práce

Abstract

This diploma thesis deals with the legal and ethical aspects of disguised agency employment and illegal work, with particular emphasis on the protection of foreign workers. In the first part of the thesis I analyse the legal regulation of agency employment in the Czech Republic, including historical and legislative development. The second part explores the ethical aspects of disguised agency employment, as well as covert employer practices. In the third part of the thesis I focus on the issue of illegal work, its various forms, and the socio-economic consequences associated with it. The fourth part compares the Czech legal framework with foreign regulation. Based on these findings, I formulate recommendations for improving the legal and ethical framework in the Czech Republic. Description of how AI was used In writing this thesis, was used artificial intelligence tools for formal editing of the text (chatGPT.com, perplexity.ai) and translation of foreign sources (deepL.com). Tato diplomová práce se zabývá právními a etickými aspekty zastřeného agenturního zaměstnávání a nelegální práce, se zvláštním důrazem na ochranu zaměstnanců cizinců. V první části práce analyzuji právní úpravu agenturního zaměstnávání v České republice včetně historického a legislativního vývoje. Ve druhé části práce se zaměřuji na etické aspekty zastřeného agenturního zaměstnávání a skryté praktiky zaměstnavatelů. Ve třetí části práce se zabývám problematikou nelegální práce, jednotlivými formami a sociálně-ekonomickými důsledky nelegální práce. Ve čtvrté části práce se zaměřuji na komparaci se zahraniční právní úpravou. Na základě těchto zjištění formuluji doporučení pro zlepšení právního a etického rámce v České republice. Popis využití AI Při psaní této práce jsem použila nástroje umělé inteligence za účelem formálních úprav textu (chatGPT.com, perplexity.ai) a překladů zahraničních zdrojů (deepL.com). Nástroje byl využity pouze k těmto technickým činnostem, aby byla zajištěna lepší srozumitelnost a konzistentnost textu.
