Abstract

Zástupci zaměstnanců pohledem českého a německého práva se zaměřením na odborové organizace Diplomová práce se zabývá zástupci zaměstnanců a jejich právní regulací v rámci českého a německého práva. Práce si klade za cíl nejen popsat právní úpravu zástupců zaměstnanců, podmínky jejich vzniku a jejich práva a povinnosti, ale také nabídnout návrhy, které by směřovaly k jejich spravedlivějšímu a efektivnějšímu fungování. Práce je rozdělena do několika částí. V úvodu je obsaženo pojednání o jednotlivých zástupcích zaměstnanců, tato část popisuje jednotlivé druhy zastoupení v českém a německém právu, včetně odborových organizací, rad zaměstnanců, evropských rad zaměstnanců a specializovaných zástupců (zástupce pro BOZP, zástupce mladistvých, zástupce osob s těžkým hendikepem, zástupce vedoucích zaměstnanců). Následuje analýza normativního zakotvení odborových organizací na ústavní i zákonné úrovni a jejich komparace. Hlavní jádro práce představuje porovnání klíčových aspektů fungování odborových organizací, jejich vznik a působení u zaměstnavatele, jejich práva a jejich role v rámci kolektivního vyjednávání společně s náležitostmi aplikace kolektivních smluv na zaměstnance. Representatives of the employees in the perspective of Czech and German law with focus on trade unions This thesis examines employee representatives and their legal regulation within the Czech and German legal systems. Its aim is not only to describe the legal framework governing employee representatives, the conditions of their establishment, and their rights and obligations, but also to put forward proposals that may contribute to their fairer and more efficient functioning. The thesis is divided into number of parts. The introductory section discusses the individual types of employee representatives and describes the forms of representation under Czech and German law, including trade unions, works councils, European works councils, and specialised representatives (such as the occupational health and safety representative, youth representative, representative of persons with severe disabilities, and representative of managerial staff). This is followed by an analysis of the normative regulation of trade unions at both constitutional and statutory level and their comparison.
