Možnosti využití plošné databáze DNA profilů v kriminalistické praxi

Abstract

This thesis deals with the issue of the use of DNA profile databases in forensic science. The aim of the thesis is to describe the functioning of these databases in the Czech republic, to analyse relevant legal framework, and to assess whether the current regulation complies with requirements arising from case law interpreting Article 8 of the European Convention on Human Rights. Attention is also paid to studies evaluating the effectiveness of DNA databases and to the theoretical concept of a so-called universal DNA database, which would include profiles of the entire population of a given state. The thesis presents main arguments of this approach from legal and practical perspectives.

Diplomová práce se zabývá problematikou využívání databází DNA profilů v kriminalistice. Cílem práce je popsat fungování těchto databází v České republice, analyzovat právní úpravu a posoudit, zda současná úprava odpovídá požadavkům vyplývajících z judikatury podle znění čl. 8 Evropské úmluvy o ochraně lidských práv. Pozornost je věnována studiím efektivity databází i teoretickému konceptu tzv. univerzální databáze DNA, která by zahrnovala profily celé populace určitého státu. Práce představuje hlavní argumenty tohoto řešení z právního i praktického hlediska.
