Abstract

Trestněprávní úprava hate speech a její dopady na svobodu slova Abstrakt Tato diplomová práce se zabývá problematikou trestněprávní regulace tzv. hate speech. Práce toto obsáhlé téma zpracovává ze tří hlavních hledisek, podle kterých je strukturována do svých tří částí. První část práce se soustředí na trestněprávní úpravu hate speech v předpisech platných na našem území. Nejprve ověří, zda v ní dochází ke zpřísňování trestněprávní regulace hate speech. Za tímto účelem provede historickou studii této úpravy v dosud neprovedené úplnosti. V rámci analýzy současné trestněprávní úpravy hate speech práce de lege ferenda zhodnotí některé její potenciální nedostatky. Druhá část práce se věnuje judikatuře ESLP týkající se hate speech, respektive na ní reagujících omezení práva na svobodu projevu. ESLP při jejich posuzování přihlíží ke konkrétním okolnostem jednotlivých případů, za což mu bývá vytýkána nepředvídatelnost jeho judikatury. Práce se pokusí z bohaté judikatury ESLP abstrahovat kritéria, podle kterých omezení svobody projevu posuzuje. Zároveň se pokusí ukázat, proč může být individuální přístup k hate speech vzhledem k její rozmanitosti vhodný. Criminal regulation of hate speech and its impact on the freedom of speech Abstract This thesis deals with the issue of criminal law regulation of so-called hate speech. It approaches this broad topic from three main perspectives, which also form the structure of its three parts. The first part focuses on the criminal law framework concerning hate speech in the legislation applicable in the territory of the current Czech Republic. It verifies whether this framework has become more restrictive over time. To this end, it conducts a historical study of the relevant regulation in a scope not previously undertaken in the local context. While examining the regulation, the thesis also evaluates certain potential shortcomings from a de lege ferenda perspective. The second part is dedicated to the case law of the European Court of Human Rights (ECHR) related to hate speech and the corresponding restrictions on freedom of expression. In its assessments, the ECHR considers the specific circumstances of individual cases, which has led to criticism of unpredictability of the case law. The thesis attempts to abstract from the ECHR's extensive jurisprudence the criteria according to which such restrictions are assessed.
