Vztah státu a církví pohledem principů demokratického právního státu

Abstract

Diplomová práce se věnuje problematice ústavněprávní roviny vztahu státu a církví. Konkrétně zkoumá dvě pojetí kooperačního modelu vztahu státu a církví, a to zaprvé jeho slabou formu uplatňovanou v ČR a zadruhé jeho silnou formu v SRN. Úkolem práce je identifikovat rozdílné a shodné znaky obou zkoumaných forem kooperačního modelu a následně je zhodnotit. Zhodnocení odlišných prvků slouží jako příspěvek do diskuse ohledně potenciálních legislativních změn, kterými mohou oba systémy v budoucnu projít. Prostřednictvím identifikace odlišných prvků práce odhaluje i jejich shodné prvky, které mohou posloužit k teoretickému pochopení kooperačního modelu jako takového. Práce se skládá ze dvou částí. V první části jsou definovány pojmy církev, principy sekulárního státu a autonomie církví, a to včetně jejich zasazení do kontextu demokratického právního státu, a následně jsou v obecné rovině popsány jednotlivé modely vztahu státu a církví. Druhá část práce obsahuje popis ústavněprávně relevantních prvků obou systémů, které mají návaznost na principy sekulárního státu a autonomie církví. The thesis deals with the constitutional aspects of the relationship between the state and churches. Specifically, it examines two concepts of the cooperation model of the relationship between the state and churches, namely its weak form as applied in the Czech Republic and its strong form as applied in Germany. The aim of the thesis is to identify the differences and similarities between the two forms of the cooperation model and then to evaluate them. The evaluation of the different elements serves as a contribution to the discussion on potential legislative changes that both systems may undergo in the future. By identifying the different elements, the thesis also reveals their similarities, which can serve to provide a theoretical understanding of the cooperation model as such. The thesis consists of two parts. The first part defines the concepts of church, the principles of a secular state and the autonomy of churches, including their place in the context of a democratic state governed by the rule of law, and then describes the individual models of the relationship between the state and churches in general.
