Abstract

Punishment in Ethics As the name of the paper suggests, this bachelors thesis should be dealing with the conception of punishment by philosophical approaches in ethics, mainly by the utilitarian-consequential and retributive view. I want to show, how each account views the purpose of punishment, how it fits it their own philosophical framework, how they justify punishment and what form should punishment take. It will be necessary to describe utilitarianism and consequentialism and their relation with punishment, philosophical approaches that are connected with maximalization of positive consequences and minimalization of negative ones. To a similar critical reading will undergo retributivism, where actions have their own value and agents must deal with moral demands. Together with the question about how much are these two approaches contradictory, with their suppositions and goals, we are getting to the third approach, the so-called hybrid approach of punishment. It presents an attempt to unite these seemingly opposite approaches. It will be necessary to explain and examine in detail retributivism and consequential theories in the beginning, so that we can inspect afterwards hybrid theories, if these synthesis are without inherent discrepancies, if they reflect the demands which are essential for both...

Trest v etice Jak název napovídá, bakalářská práce by se měla zabývat tím, jak je pojímán trest, filosofickými přístupy v etice, a to převážně z utilitaristického-konsekvencialistického a retributivního pohledu. Chci ukázat, jak jednotlivé pohledy nahlíží na účel trestu, jak trest zapadá do jejich vlastního filosofického rámce, jak ho ospravedlňují a jakou podobu má mít trest. Bude zapotřebí popsat utilitarismus a konsekvencialismus a jejich vztah k trestu, filosofické přístupy, jež se pojí s maximalizací pozitivních důsledků a minimalizací negativních důsledků. Podobnému kritickému výkladu bude dále podroben retributivismus, kde činy mají vnitřní hodnotu a jednající se musí potýkat s deontologickými morálními požadavky. Spolu s otázkou, zda jsou tyto přístupy protichůdné, svými předpoklady a cíli, se dostáváme k třetímu přístupu, tzv. hybridnímu pohledu na trest. Představuje snahu tyto naoko opačné přístupy sjednotit. Je zapotřebí podrobně vyložit a na začátku zkoumat retributivismus a konsekvencialistické teorie, abychom následně podrobili hybridní teorie kontrole, zda jsou tyto syntézy bez vnitřního sporu, nebo jestli reflektují požadavky, jež jsou esenciální pro obě disciplíny, a tak jsou skutečně pravou syntézou
