Abstract

Protection of the Personality Rights of Public Figures and in the Matters of the Public Interest in the Media Environment Abstract This thesis deals with the topic of the protection of the personality rights of public figures in the media environment in the light of the public interest. The issue is that the media function as watchdogs of democracy, whose task is to inform society about matters of public interest, which is often connected to the activities of public figures. It is also, a fact that public figures are required to tolarate a higher level of criticism than private persons. However, the question is, to what extent can media interfere with their personal rights in favour of the freedom of expression and the right to information and when it becomes an unjustified interference. Therefore, a conflict between two constitutionally guaranteed rights and freedom is formed, which the courts must deal with in case of disputes. In the beginning of the thesis, readers are introduced to the relevant legislation on the topic and the concepts of "media" and "mass media". Ochrana osobnosti osob veřejného zájmu a ve věcech veřejného zájmu v mediálním prostředí Abstrakt Diplomová práce se zabývá ochranou osobnosti osob veřejného zájmu v mediálním prostředí ve světle veřejného zájmu. Problematika spočívá v tom, že média fungují jako hlídací psi demokracie, jejichž úkolem je informovat společnost o věcech veřejného zájmu, který je často spjat s činností osob veřejného zájmu. Zároveň také platí, že osoby veřejného zájmu jsou povinny snést vyšší míru kritiky než osoby soukromé. Otázkou však je, nakolik mohou média zasahovat do jejich osobnostních práv ve prospěch svobody projevu a práva na informace, a kdy se ono sdělení stává již neoprávněným zásahem. Dochází proto ke střetu dvou ústavně garantovaných práv a svobod, se kterým se musí v případě sporů vypořádat soudy. Na začátku práce jsou čtenáři seznámeni s relevantní právní úpravou na toto téma a s pojmy "média" i "masmédia". Vhodné je poukázat na to, že s rozmachem sdělovacích prostředků nemusí být původci zásahů již jen mediální společnosti, nýbrž i jednotlivci. Jádrem práce jsou však kapitoly analyzující dosavadní judikaturu českých soudů a ESLP, v rámci nichž má dojít k hledání odpovědi na otázku: "Existuje určitý algoritmus rozhodovací praxe, díky kterému dokážeme předurčit budoucí rozhodnutí v obdobných případech?".
