Abstract

Changes in the concept of authorship in the context of the development of artificial intelligence Abstract The thesis focuses on changes in the concept of authorship in connection with the development of artificial intelligence and examines how the Czech legal framework should respond to new types of outputs generated using these technologies. The primary aim was to define the fundamental concepts and principles of generative AI, analyse the current state of copyright law as applied to AI-assisted creation and complement this with selected foreign approaches, concluding with an outline of potential legislative developments aimed at enhancing legal certainty in this area. The introductory part of the thesis provides a systematic analysis of definitions and principles of artificial intelligence, its development and characteristics, with an emphasis on generative AI systems. The second part focuses on the application of Czech copyright law to AI- assisted creation and analyses the essential conceptual features of a copyrighted work, the requirement of originality, and current case law, including the decision of the Prague Municipal Court, which so far represents the only domestic instance of judicial engagement with this issue. Změny pojetí autorského díla v souvislosti s vývojem umělé inteligence Abstrakt Práce se zaměřila na změny pojetí autorského díla v souvislosti s vývojem umělé inteligence a na otázku, jakým způsobem by měl český právní řád reagovat na nové typy výstupů vznikajících s využitím těchto technologií. Cílem bylo především vymezit základní pojmy a principy generativní AI, analyzovat současný právní stav v oblasti autorského práva při tvorbě za využití AI a doplnit jej o vybrané zahraniční přístupy, a v závěru nastínit možné směry legislativního vývoje, které by zvýšily právní jistotu v této oblasti. Úvodní část práce poskytla systematický rozbor definic a principů umělé inteligence, její vývoj a vlastnosti, s důrazem na generativní systémy AI. Druhá část se soustředila na aplikaci autorského zákona na tvorbu za použití AI a analyzovala základní pojmové znaky autorského díla, požadavek originality a aktuální judikaturu, včetně rozhodnutí Městského soudu v Praze, které zatím představuje jediný tuzemský případ judikaturního uchopení této problematiky. Zvláštní pozornost byla věnována evropskému právu a harmonizovanému standardu vlastní duševní tvorby vymezenému Soudním dvorem EU, jakož i vybraným zahraničním přístupům, které mohou sloužit jako inspirace pro český právní rámec.
