Problematika deepfake pornografie z kriminologického pohledu aneb její podstata, příčiny a prevence

Abstract

The goal of this thesis was to closely analyze, from the perspective of criminology, the phenomenon of creating and spreading deepfake pornography (sexually explicit content generated or manipulated by AI). The phenomenon is analyzed through the three basic criminological categories - phenomenology, etiology and the control of crime rate. In other words, I focus on the essence of the activity, its possible causes and the possible prevention and repression. In the phenomenology chapter I aim to offer a coherent description of the basics of artificial intelligence and its functions, with a specific focus on AI models, which use the deep learning algorithms. I then further explain this information on the specifics of using AI to create deepfake pornography, especially on the methods of generating videos, photos or audio recordings. A major part of the chapter is dedicated to explaining the ways the potential perpetrator can exploit the internet and social media to gain access to the source material, which can be further used to produce deepfake pornography. This includes the role of Czech civil law in the protection of publicly shared content. Cílem této práce bylo blíže rozebrat trestněprávní fenomén tvorby a šíření sexuálně explicitních materiálů upravených či generovaných pomocí umělé inteligence (tzv. deepfake pornografie) z pohledu kriminologie. S ohledem na pokrok v moderních technologiích se jedná o téma vysoce aktuální a s ohledem na relativní jednoduchost páchání této činnosti také o téma představující hrozbu pro společnost a výzvu pro systém práva. V práci postupně zkoumám tento fenomén prostřednictvím tří základních kriminologických pilířů, tj. z pohledu kriminologické fenomenologie, kriminologické etiologie a kontroly kriminality. Jinými slovy se zaměřuji na její podstatu, příčiny a prevenci, resp. represi. V kapitole zkoumající podstatu této činnosti nejprve čtenáři obecněji přibližuji fenomén umělé inteligence, zejména pak s důrazem na AI softwary fungující na bázi hlubokého učení. Obecné východiska následně aplikuji na první z klíčových složek probírané trestné činnosti, tj. na samotnou tvorbu deepfake pornografie. Popisuji technická specifika tvorby jednotlivých nejčastějších druhů deepfake pornografických děl - videí, fotografií a zvukových nahrávek. Zároveň rozebírám i způsoby, jakými může pachatel zneužívat internet a sociální sítě při získávání zdrojového materiálu k tvorbě, a to včetně civilněprávní problematiky...
