Abstract

Free movement of persons and services in the field of abortion Abortion, or the deliberate artificial termination of pregnancy, has been associated with humanity since ancient times. Throughout history, abortion has often been a political issue, and this is no different today in the European Union and elsewhere in the world. This thesis discusses the legal regulation of abortion in the European Union and focuses on its relationship with its internal market, specifically its relationship with the free movement of persons and the free movement of services. The first part of the thesis places abortion in a broader social context, describing the conflicting currents of opinion and the conflict between the right to life of the foetus or mother and the right to freedom. The second part of the thesis deals with the legal sources of abortion and its institutional framework. After describing the international sources, this part puts special emphasis on the human rights sources in Europe, namely the Charter of Fundamental Rights of the European Union and the European Convention on Human Rights and related case law. Volný pohyb osob a služeb v oblasti interrupce Interrupce neboli vědomé umělé přerušení těhotenství je s lidstvem spojeno už od starověku. V průběhu historie byla interrupce často politické téma a jinak tomu není ani dnes na území Evropské unie a jinde ve světe. Tato diplomová práce pojednává o právní úpravě interrupce v Evropské unii a zaměřuje se na její vztah s jejím vnitřním trhem, konkrétně vztah s volným pohybem osob a volným pohybem služeb. První část diplomové práce zasazuje interrupci do širšího společenského kontextu, popisuje protichůdné názorové proudy a konflikt práva na život plodu nebo matky s právem na svobodu. Druhá část diplomové práce řeší právní prameny interrupce a její institucionální rámec. Po popsání mezinárodních pramenů klade tato část speciální důraz na lidskoprávní prameny na území Evropy, konkrétně na Listinu základních práv Evropské unie a na Evropskou úmluvu o ochraně lidských práv a související judikaturu. Dále tato práce řeší, zda je interrupce explicitně vyjádřena v primárním právu, neboť Evropský parlament v posledních letech vydal celkem tři usnesení týkající se interrupce.
