Abstract

Marine genetic resources in light of the BBNJ Agreement This thesis deals with the legal regulation of marine genetic resources in areas beyond national jurisdiction, in particular their new regulation under the Agreement under the United Nations Convention on the Law of the Sea on the Conservation and Sustainable Use of Marine Biological Diversity of Areas beyond National Jurisdiction (so-called "BBNJ Agreement"). It focuses on the regulation of access to marine genetic resources and the sharing of benefits arising from activities connected to them, and on the equity of the new system. The thesis is divided into four chapters. The first chapter focuses on the concepts of (marine) biodiversity, marine genetic resources and their relevance to humans, including specific examples of their potential use. The second chapter then describes the legal regulation of marine genetic resources in areas beyond national jurisdiction that is still in force, with the greatest emphasis on the UN Convention on the Law of the Sea and the principles of the common heritage of mankind and freedom of the high seas. Mořské genetické zdroje ve světle BBNJ dohody Tato diplomová práce pojednává o právní úpravě mořských genetických zdrojů v oblastech za hranicemi národní jurisdikce, zejména o jejich nové právní úpravě dle Dohody v rámci Úmluvy Organizace spojených národů o mořském právu o zachovávání a udržitelném využívání mořské biologické rozmanitosti v oblastech za hranicemi národní jurisdikce (Agreement under the United Nations Convention on the Law of the Sea on Marine Biodiversity of Areas Beyond National Jurisdiction, tzv. "BBNJ dohoda"). Soustředí se přitom zejména na právní úpravu přístupu k mořským genetickým zdrojům a sdílení přínosů plynoucích z činností, které se jich týkají a na spravedlnost tohoto systému. Práce je rozdělena do čtyř kapitol. První kapitola se věnuje pojmům (mořské) biologické rozmanitosti, mořských genetických zdrojů a jejich významu pro člověka, včetně konkrétních příkladů jejich možného využití. Druhá kapitola pak popisuje dosud platnou právní úpravu mořských genetických zdrojů v oblastech za hranicemi národní jurisdikce, přičemž největší důraz klade na Úmluvu OSN o mořském právu a principy společného dědictví lidstva a svobody volného moře.
