Ukrajinská eurointegrace: Proces europeizace právních systémů v kontextu války

Abstract

This bachelor9s thesis examines the process of Europeanisation in Ukraine, with a specific focus on reforms in the areas of justice and home affairs, which are considered core components of the broader legal system. The legal system is understood here as a set of institutions, rules, and mechanisms ensuring the rule of law, individual rights protection, and effective public administration. These sectors are essential for fulfilling the political and institutional requirements for EU accession, as defined by the Copenhagen criteria. The thesis analyses the legal, institutional, and administrative transformations carried out from the signing of the Association Agreement with the EU in 2014 up to the present day, with particular emphasis on developments following the granting of candidate status in 2022. Special attention is paid to the barriers, shortcomings, and contradictory dynamics accompanying the reform process. The aim is to critically assess whether Europeanisation in these sectors reflects a deep and sustainable transformation or remains largely formal and declarative. The research is based on qualitative analysis and comparative index-based evaluations of Ukraine9s readiness for EU membership.

Právní systém je zde chápán jako soubor institucí, pravidel a mechanismo, které zajiaeují fungování právního státu, ochranu práv jednotlivce a efektivní veYejnou správu. Tyto sektory pYedstavují klí ový pYedpoklad pro splnní politických a institucionálních kritérií lenství v Evropské unii, známých jako kodaIská kritéria. Práce analyzuje legislativní, institucionální a administrativní promny, které probíhají od podpisu Asocia ní dohody s EU v roce 2014 a do sou asnosti, pYi em zvláatní pozornost je vnována období po udlení kandidátského statusu v roce 2022. Zvláatní doraz je kladen na pYeká ky, nedostatky a protichodné tendence, které evropské reformy provázejí. Cílem je kriticky posoudit, zda proces europeizace v uvedených oblastech vykazuje známky hluboké a udr itelné transformace, nebo zda zostává spíae povrchní a formální. Výzkum je zalo en na kvalitativní analýze a komparaci indexových hodnocení pYipravenosti Ukrajiny na lenství v EU.
