Abstract

The Legal Protection of Patients with ALS and Other Progressive Diseases: Assessment of Gaps in the Health and Social Systém Abstract This thesis examines the legal protection of patients with amyotrophic lateral sclerosis (ALS) and other progressive diseases within the Czech health and social care system. The aim of the thesis is to identify and analyze the main systemic gaps that affect the availability, quality, and effectiveness of care for this vulnerable group, and to propose specific measures to improve their situation. The work is based on a combination of legal analysis, a review of scholarly literature, interviews with experts and patient organizations, and also takes into account the author's personal experience caring for a relative with ALS. The theoretical section describes the nature of progressive diseases, with an emphasis on ALS as a model example for studying legal and systemic challenges. This is followed by an analysis of the legal framework for health and social care, including the processes of disability assessment, entitlement to care allowance, benefits in material need, and support options for informal carers. Právní ochrana pacientů s ALS a jinými progresivními onemocněními: Posouzení mezer zdravotního a sociálního systému Abstrakt Tato diplomová práce se zabývá právní ochranou pacientů s amyotrofickou laterální sklerózou a dalšími progresivními onemocněními v českém zdravotním a sociálním systému. Cílem práce je identifikovat a analyzovat hlavní systémové mezery, které ovlivňují dostupnost, kvalitu a efektivitu péče o tuto zranitelnou skupinu, a navrhnout konkrétní opatření ke zlepšení jejich postavení. Práce vychází z kombinace právní analýzy, studia odborné literatury, rozhovoru s ředitelkou pacientské organizace ALSA a zohledňuje i osobní zkušenost autorky s péčí o blízkého s ALS. V teoretické části je popsána povaha progresivních onemocnění, s důrazem na ALS jako modelový příklad pro studium právních a systémových výzev. Následuje rozbor právního rámce zdravotní a sociální péče, včetně procesů posuzování invalidity, přiznání příspěvku na péči, dávek v hmotné nouzi a možností podpory pečujících osob. Samostatná kapitola je věnována sociálním službám, jejich dostupnosti, financování a odpovědnosti poskytovatelů.
