Levinas a otázka spravedlnosti

Abstract

This thesis examines the concept of justice in the work of Emmanuel Levinas, specifically in his early texts prior to the publication of Totality and Infinity. We focus on the problem of the entry of a third party into a face-to-face relationship, which at a certain point in Levinas's thinking raises questions about justice, the state and its institutions, law, and equality. It is precisely the tension between ethics based on the relationship to the other and the demand for institutional justice that arises with the figure of the third that forms the axis of this work. We attempt to trace how Levinas articulates the tension between these two poles, whether and how he connects them in his early texts, against the backdrop of three motifs, namely justice, the permeation of the ethical order into economic justice, and equality. In the last part, we focus on the question of the so-called original right of the other, and in the conclusion, we attempt to propose a Levinas-inspired perspective on the protection of rights based on the concepts of care, equality, trust, and hope.

Tato práce zkoumá pojetí spravedlnosti v díle Emmanuela Levinase, a to v jeho ranných textech do publikování Totality a nekonečna. V práci se zaměřujeme na problém vstupu třetího do vztahu tváří v tvář, který v určitém bodě Levinasova myšlení znamená nastolení otázky spravedlnosti, státu a jeho institucí, práva a rovnosti. Právě napětí mezi etikou založenou na vztahu k druhému a požadavkem na institucionální spravedlnost, který vzniká s postavou třetího tvoří osu této práce. Snažíme se sledovat, jak Levinas artikuluje napětí mezi těmito dvěma póly, zda a jak je propojuje ve svých raných textech, a to na pozadí tří motivů, konkrétně spravedlnosti, prozařování etického řádu do ekonomické spravedlnosti a rovnosti. V poslední části se věnujeme otázce tzv. původního práva druhého a v samotném závěru se snažíme navrhnout Levinasem inspirovanou perspektivu ochrany práv založenou na pojmech péče, rovnosti, důvěry a naděje.
