Abstract

Regulation of the crypto asset market Abstract This thesis analyses the current legal regulation of the cryptoasset market, focusing on legislation in the European Union and the Czech Republic. The thesis aims to present and evaluate the new regulatory framework, highlight its benefits and risks, and assess its effectiveness for the cryptoasset market. The thesis is structured into four main parts. The first chapter defines key terms and places them in the context of their practical use around the world. The second chapter focuses on general regulation, presenting the legal framework in the Czech Republic classified according to the legal force of individual norms and then comparing it with the approaches of selected foreign jurisdictions (Switzerland, China, El Salvador, USA), thus demonstrating the diversity of regulatory strategies. The third, pivotal chapter provides a detailed analysis of Regulation (EU) 2023/1114 of the European Parliament and of the Council, known as the MiCA Regulation. Regulace na trhu s kryptoaktivy Abstrakt Diplomová práce se zabývá analýzou současné právní regulace na trhu s kryptoaktivy se zaměřením na právní úpravu v Evropské unii a České republice. Cílem práce je představit a zhodnotit nový regulační rámec, poukázat na jeho přínosy i rizika a posoudit jeho účelnost pro trh s kryptoaktivy. Práce je strukturována do čtyř hlavních částí. První kapitola definuje klíčové pojmy a zasazuje je do kontextu jejich praktického využití po celém světě. Druhá kapitola se věnuje obecné regulaci, přičemž představuje právní úpravu v České republice klasifikovanou dle právní síly jednotlivých norem a následně provádí komparaci s přístupy vybraných zahraničních jurisdikcí (Švýcarsko, Čína, El Salvador, USA), čímž demonstruje různorodost regulatorních strategií. Třetí, stěžejní kapitola, poskytuje detailní rozbor nařízení Evropského parlamentu a Rady (EU) 2023/1114, známého jako nařízení MiCA. Analyzuje klíčové instituty tohoto nařízení, včetně klasifikace tokenů, kritéria posouzení nakolik naplňuje kryptoaktivum definici finančního nástroje, zavedení povinného povolení pro poskytovatele služeb souvisejících s kryptoaktivy, požadavků na obsah tzv. bílé knihy (whitepaperu) a pravidla travel rule.
