Abstract

Legal Aspects of the Adoption and Functioning of the Common Currency in the Czech Republic Abstract The rigorous thesis focuses on the legal and practical implications associated with the introduction of the euro in the Czech Republic. The main intention of this thesis is to describe and analyze the degree of the Czech Republic's integration into the structures of the European Union and to assess the impact of euro area accession on selected aspects of the Czech legal order. The thesis defines the individual institutions of both the EU and the Czech Republic, describes their current functioning, and examines the consequences that the adoption of the euro will have for these institutions, with emphasis on the powers that will need to be changed. These powers are identified in detail, including the extent to which they will shift from national authorities to EU institutions. The thesis also evaluates the Czech Republic's current status regarding the fulfilment of the Maastricht convergence criteria for euro adoption, concluding- based on analysis of the current situation that the Czech Republic does not yet meet these criteria. Právní aspekty přijetí a fungování společné měny v ČR Abstrakt Rigorózní práce se zabývá tématem právních a praktických dopadů, které nastanou v souvislosti se zavedením eura v ČR. Vytyčeným cílem je popsat a analyzovat míru integrace ČR do struktur EU a posoudit dopady vstupu do eurozóny na vybrané aspekty českého právního řádu. Práce vymezuje jednotlivé instituce EU a ČR, popisuje jejich současné fungování a důsledky, které bude pro tyto instituce zavedení eura v ČR mít, s důrazem na jejich pravomoci, které se budou muset změnit. Tyto pravomoci také konkrétně pojmenovává a popisuje míru jejich přesunu z národních orgánů na orgány EU. Součástí je také zhodnocení aktuálního postavení ČR v souvislosti s naplňováním Maastrichtských kritérií pro vstup do eurozóny. Spadá zde také popis současné míry integrace do EU, konkrétně s důrazem na hospodářskou a měnovou unii a zhodnocení jejích pozitivních a negativních aspektů. Ze zkoumaných právních změn, které proběhly v minulosti v souvislosti se vstupem do eurozóny v jiných členských státech EU, konkrétně na Slovensku a v Německu, vycházejí poznatky aplikované při samotné analýze změn v rámci právního řádu ČR.
