Abstract

Critical analysis of the Regulation of the European Parliament and of the Council on markets in crypto-assets, and amending Regulations and Directives Abstract On the 16th of May 2023 the Council of the European Union adopted the Regulation of the European Parliament and of the Council on markets in crypto-assets, and amending Regulations and Directives, which fully entered into force on the 30th of December 2024. The regulation's subject are markets in crypto-assets, specifically obligations of crypto-asset issuers and crypto-asset service providers as well as rules on market abuse involving crypto-assets. The regulation's explanatory memorandum sets out four goals for the regulation, the most important of which is the support of innovation. This thesis concerns itself with whether and to what extent the regulation fulfills this objective. The thesis is split into three parts. The first part examines what crypto-assets are and what categories the regulation splits them into. Further it examines the history of crypto-assets with attention paid to important innovative milestones, amongst which this thesis counts the Blind Signature technology, the corporation DigiCash, the digital currency E-gold and the following crypto-assets: Bitcoin, Litecoin and Ether. Kritická analýza nařízení Evropského parlamentu a Rady o trzích kryptoaktiv a o změně nařízení a směrnic Abstrakt Rada Evropské unie přijala dne 16. května 2023 nařízení Evropského parlamentu a Rady o trzích kryptoaktiv a o změně nařízení a směrnic, které nabylo plnou účinnost 30. prosince 2024. Nařízení upravuje trhy kryptoaktiv, specificky povinnosti vydavatelů kryptoaktiv, poskytovatelů služeb, které s kryptoaktivy souvisejí a zavádí pravidla zneužívání trhu týkající se kryptoaktiv. Důvodová zpráva nařízení o trzích kryptoaktiv vytyčuje čtyři cíle, které má splnit, ze kterých je asi nejdůležitějším podpora inovací. Tato práce se zabývá tím, zdali a do jaké míry nařízení tento cíl splňuje. Práce dělí do tří částí. První část zkoumá, co to jsou kryptoaktiva a jak je nařízení o trzích kryptoaktiv dělí a dále probírá historii kryptoaktiv s důrazem na významné inovativní milníky, mezi které práce řadí technologii Blind Signature, společnost DigiCash, digitální měnu E-gold a kryptoaktiva Bitcoin, Litecoin a Ether.
