67 ZÁVĚR Kolektivní investování je alternativou investování, která nabízí drobným i profesionálním investorům možnosti zhodnocení svých volných peněžních prostředků investicemi do široké nabídky investičních produktů prostřednictvím fondů kolektivního investování, které peněžní prostředky investují do investičních nástrojů různých emitentů na principu omezení a rozložení rizika, při dodržení pravidel profesionální správy a odborné péče. Nezbytným předpokladem pro fungování kolektivního investování je vytvoření právního rámce, který na jedné straně bude chránit zájmy a majetek investorů a na druhé straně bude zajišťovat efektivní fungování kolektivního investování. Právní úprava kolektivního investování přesahuje, zejména na evropské úrovni, hranice jednotlivých států. Kolektivní investování jako významný segment jednotného evropského trhu je předmětem harmonizace na úrovni EU. Přijetím směrnice o SKIPCP a především pozdějšími novelizacemi v roce 2001 vznikla možnost na základě tzv. jednotného evropského pasu distribuovat fondy kolektivního investování, tzv. SKIPCP fondy, v rámci členských států. Díky vysokým požadavkům směrnice o SKIPCP na ochranu investorů přesahuje nabízení SKIPCP fondů hranice EU a fondy jsou distribuovány na mimoevropských trzích (Asie, Latinská Amerika). RESUMÉ "Collective Investments and its Legal Regulation" Klíčová slova: kapitálový trh, investice, fondy Key words: capital market, investment, funds The dissertation is focused on a complex regulation of the collective investments according to Czech law and European law. The first chapters shall determine basic characteristics and definition of the collective investment, its role in the financial market and basic differences between collective investments and individual investments. The next chapter shall summarize history of the collective investment in the Czech Republic during last 20 years and identify the important data in the history of Czech collective investment. The third chapter shall determine the current legal framework in the area of collective investment in the Czech Republic and European Union. The following chapters shall describe units of the collective investments and other institutions, their basic characteristics, requirements for their foundation and obtaining a licence to distribute their services and products in the financial market and regulation according to requirements for the assets, investment policy and risk diversification.
