Snahy o zavedenie National Popular Vote Interstate Compact v Spojených štátoch amerických.

Abstract

The bachelor thesis primarily focuses on the National Popular Vote Interstate Compact initiative, which aims to ensure, that the President of the United States is elected based on the outcome of the nationwide popular vote, and on the potential impacts of its implementation on the election process in the United States of America. This thesis presents the historical development and the current structure of the electoral system, with an emphasis on the functioning of the Electoral College system. Within the topic of the National Popular Vote Interstate Compact, the thesis focuses on the political context of the emergence of this initiative, the principle of its operation, as well as the fundamental legal bases on which the proposal is built. The aim of this thesis was to analyze the impacts that the implementation of the initiative would have on the federal system and the electoral process in the United States. Descriptive, comparative, process tracing and case study methods were used to achieve the results. The results of the thesis indicate that the implementation of the initiative would fundamentally affect the electoral process, since the winner would be elected based on the popular vote, which could lead to a discrepancy between the winner of the popular vote and the winner of the Electoral...

Bakalárska práca sa primárne zaoberá iniciatívou National Popular Vote Interstate Compact, ktorej cieľom je presadiť, aby bol prezident Spojených štátov volený na základe výsledku celonárodného ľudového hlasovania, a potenciálnymi dopadmi jej implementácie na proces prezidentskej voľby v Spojených štátoch amerických. V práci je predstavený historický vývoj a súčasné nastavenie volebného systému s dôrazom na fungujúci systém Electoral College. V rámci témy National Popular Vote Interstate Compact sa práca zameriava na politický kontext vzniku tejto iniciatívy, na princíp jej fungovania, ako aj na základné legislatívne východiská, na ktorých je návrh postavený. Cieľom práce bolo analyzovať, aké dopady by malo zavedenie iniciatívy na federálny systém a volebný proces v Spojených štátoch. Na dosiahnutie výsledkov boli použité metódy deskripcie, komparácie, procesného trasovania a prípadovej štúdie. Výsledky práce ukazujú, že zavedením iniciatívy by bol zásadným spôsobom ovplyvnený volebný proces, keďže víťaz by bol volený na základe zisku ľudových hlasov, čo by mohlo viesť k nesúladu medzi víťazom ľudových a víťazom voliteľských hlasov.
