Právní úprava společenství vlastníků jednotek a jeho problematika v praxi

Abstract

55 Závěr Problematika bytového vlastnictví, především pak institutu společenství vlastníků jednotek, je značně složitá a současná právní úprava obsahuje celou řadu rozporuplných ustanovení a četných mezer. Tyto nedostatky přispívají k celkovému nepochopení právní úpravy institutu společenství vlastníků jednotek a jeho fungování a stěžují tak aplikaci předmětných ustanovení v praxi. Nepříliš propracovaná a současně komplikovaná úprava této právní oblasti se tak u veřejnosti nesetkává s kladnou odezvou. Nedostatky právní úpravy se zákonodárce pokoušel řešit prostřednictvím několika novel zákona o vlastnictví bytů. Tyto novely však do zákona o vlastnictví bytů i přes učiněné změny nepřinesly odstranění všech sporných otázek a mnohdy vnesly do právní úpravy nové nejasnosti. Samotným jádrem mé práce je pojednání o institutu společenství vlastníků jednotek. Odlišně od předchozí úpravy považuje zákon č. 72/1994 Sb., o vlastnictví bytů a nebytových prostor, v platném znění, společenství vlastníků jednotek za právnickou osobu. Do účinnosti zákona č. 103/2000 Sb. byla společenství právní subjektivita odpírána, což činilo jeho každodenní fungování značně komplikovanějším. 59 Cizojazyčné resumé The legal regulations of the unit owners' association and its issues in practice The questions in regards to the flat ownership and unit owners' association are very topical nowadays, mainly with respect to the fact that this subject affects the daily life of many addressees of law regulations. The poor elaboration of the legal regulations of the unit owners' association led to a negative response from the public. This legal regulation is rather complicated and inconsistent. The legislator made the attempt to resolve the imperfections in the legal regulations through several amendments of the flat ownership law; however, these amendments did not abrogate all the moot questions and many times brought other confusions into the legal regulations. I discuss the most important amendments mentioned above at the beginning of my thesis.
