Metodika vyšetřování vražd (vybrané problémy)

Abstract

Obsahem této diplomové práce jsou vybrané problémy metodiky vyšetrování vražd. V úvodu je poukázáno na dynamiku vývoje vražd v Ceské republice za posledních osm let a dokumentováno statistickými daty. V práci je zmínena právní úprava trestného cinu vraždy a vraždy novorozeného dítete matkou. Pomerne strucne jsou popsány typické vyšetrovací situace, zvláštnosti predmetu vyšetrování, zvláštnosti podnetu k vyšetrování a zvláštnosti pocátecních úkonu. Prevážná cást práce se zameruje na ohledání místa cinu a ohledání tela mrtvoly. Kapitola ohledání místa cinu pojednává predevším o subjektech prítomných pri ohledání na míste cinu, o úcelu ohledání, o zásadách ohledání místa cinu a negativních okolnostech, dále o postupu na míste cinu a o dokumentaci ohledání. Kapitola ohledání mrtvoly popisuje zejména postup pri ohledání mrtvoly, urcení doby smrti a soudní pitvu. Diplomová práce je obohacena o názory, postrehy, úvahy a kritiky nekolika autoru, kterí se na toto téma zamerují ve svých cláncích, ucebnicích a publikacích a dále o kazuistiku nacerpanou z kriminalistických casopisu.

Resumé The topic of this diploma work are the chosen problematic methods of investigating the murders. At the beginning, the dynamics of the murder's development in the Czech Republic in the last eight years is emphasized. This diploma work mentions the legal regulation of the murder and infanticide. Typical investigation situations, specific characteristics of subjects and inducements for investigating and peculiarities of the starting operations are being described quite briefly. Prevailing part of the work is focused on the site inspection and the coroner's inquest. The site inspection chapter drala especially with subjects that are prezent at the site inspecton, its purpose rules and negative circumstances, further, with the proceeding of operations at the site inspection, and the coroner's inquest documentation. The coroner's inquest chapter deals particulary with the autopsy proceedings, stating the time of decease and autopsy procedure. The diploma works enriched with opinions, perceptions, considerations and criticism by some authors, who are focusing on this topic in thein speciál texts, text-books and publications. Besides, it draws even from causuistics in criminology magazines.
