Abstract

1 Role trestního práva při postihování šiřitelů záměrně nepravdivých sdělení Abstrakt Diplomová práce se zaměřuje na trestní postih šíření poplašných zpráv a záměrně nepravdivých sdělení v českém právním kontextu, se zvláštním ohledem na fenomén dezinformací. Úvodní kapitola je věnovaná vymezení cizojazyčných pojmů, jako jsou "dezinformace," "fake news," "hoax" a "misinformace," s cílem vyjasnit jejich význam a vzájemné vztahy k formám šíření záměrně nepravdivých sdělení, které trestní právo zná. Na několika stranách se práce v této části dotýká i otázek trestního postihu pomluvy a popírání zločinů podle mezinárodního práva. Třetí kapitola se zabývá historickým vývojem právních předpisů zaměřených na ochranu společnosti před šířením poplašných zpráv. Z textu vyplývá, že česká právní úprava se od poloviny 19. století vyvíjela spolu s měnícími se společenskými potřebami a reagovala na aktuální hrozby, přičemž dnešní podoba trestného činu šíření poplašné zprávy klade důraz na veřejný pořádek, aniž by naúměrně omezovala svobodu projevu a veřejnou diskusi. Dále je analyzována aplikační praxe českých soudů, které při posuzování závažnosti poplašných zpráv přihlížejí zejména ke kontextu jejich šíření, recidivě pachatelů a charakteru sdělení. 1 The Role of Criminal Law in Punishing the Disseminators of Intentionally False Statements Abstract Thesis focuses on the criminal punishment of spreading alarmist news and deliberately false statements in the Czech legal context, with particular reference to the phenomenon of disinformation. The introductory chapter is devoted to the definition of foreign language terms such as "disinformation," "fake news," "hoax," and "misinformation," with the aim of clarifying their meaning and their interrelationship to the forms of dissemination of intentionally false messages known in Czech criminal law. Within this section, the thesis also briefly addresses issues of criminalization of defamation and the denial of crimes under international law. The third chapter examines the historical development of legal regulations aimed at protecting society from the spread of alarming messages. The analysis shows that Czech legal regulations have evolved since the mid-19th century in response to changing societal needs and emerging threats. The current form of the criminal offense of spreading alarming messages emphasizes the protection of public order without unduly restricting freedom of expression or public debate.
