Abstract

INFORMOVANÝ SOUHLAS U NEZLETILÉHO PACIENTA Abstrakt Tématem této diplomové práce je problematika informovaného souhlasu u nezletilých pacientů. Dítě je nezbytným subjektem při rozhodování o jeho právech a obdobně tomu musí být i v případě poskytování zdravotních služeb. Participační práva dítěte jsou upravena již na mezinárodní úrovni, čímž je poukázáno na důležitost postavení dítěte ve společnosti, jeho názorech a postojích. Při poskytování zdravotních služeb dochází k zásahu do integrity pacienta, přičemž každý pacient, a to i nezletilý, by měl mít právo rozhodovat o svém těle. Cílem diplomové práce byl rozbor institutu informovaného souhlasu u osob nezletilých a návrh úprav de lege ferenda. V průběhu práce byla provedena rešerše nynější právní úpravy daného institutu a dále provedena analýza specifických případů, u kterých je nutné souhlas s poskytováním zdravotních služeb projevit nebo naopak, kdy souhlas nutný není. V první části práce prezentuje prameny právní úpravy, přičemž vyjmenovává nejdůležitější předpisy mezinárodního práva, ale následně také práva vnitrostátního. Ve druhé části jsou uvedeny náležitosti institutu informovaného souhlasu, projev vůle a forma souhlasu. INFORMED CONSENT FOR A MINOR PATIENT Abstract The topic of this thesis is the issue of informed consent in minor patients. The child is a necessary subject in the decision-making process regarding his/her rights and the same must be applied to the healthcare services. The child's participatory rights are already regulated at international level, which highlights the importance of the child's position in society, his or her opinions and attitudes. The provision of health services interferes with the integrity of the patient, and every patient, even minors, should have the right to make decisions about their own bodies. The aim of the thesis was an analysis of the principle of informed consent for minors and a proposal for de lege ferenda modifications. In the course of the thesis, a research of the current legal regulation of the institute was carried out, as well as an analysis of specific cases in which it is necessary to give consent to the provision of health services or, on the contrary, when consent is not necessary.
