Abstract

Mezinárodněprávní aspekty deportace dětí z Ukrajiny v kontextu ruské agrese Abstrakt Tato diplomová práce se zabývá otázkou, zda jsou deportace dětí z ukrajinského území v kontextu současného ozbrojeného konfliktu protiprávní. V první části se práce věnuje podobě deportací dětí z ukrajinského území. Nabízí definici pojmu deportace z pohledu Římského statutu Mezinárodního trestního soudu, rozbor situace předcházející počátku ozbrojeného konfliktu se zaměřením na evakuaci obyvatel z území na východě Ukrajiny a vyjmenovává způsoby a situace, ve kterých k dětským deportacím dochází. Práce se v této části věnuje rovněž filtračním táborům, tedy jedné z častých situací, v rámci nichž dochází k oddělení dítěte od rodinných příslušníků. Nachází se zde také analýza změn ruského zákona o státním občanství a prezidentských dekretů, které umožňuji udělení ruského státního občanství vymezeným kategoriím osob, včetně dětí s ukrajinským občanstvím, ve zjednodušeném řízení. Ve druhé části se práce zaměřuje na zasazení skutečností do kontextu mezinárodního práva. Nabízí přehled nástrojů mezinárodního práva, které se situací souvisí. International Legal Aspects of the Deportation of Children from Ukraine in the Context of Russian Aggression Abstract This thesis examines the question of whether the deportation of children from Ukrainian territory in the context of the current armed conflict is unlawful. The first part of the thesis focuses on the nature of deportations of children from Ukrainian territory. It provides a definition of deportation from the perspective of the Rome Statute of the International Criminal Court, analyses the situation preceding the onset of the armed conflict with a focus on the evacuation of people from the eastern regions of Ukraine, and enumerates the ways and circumstances in which child deportations occur. This part also addresses filtration camps, where children often get separated from their families. Additionally, this part analyses changes to Russian citizenship law and presidential decrees facilitating expedited Russian citizenship for specific groups, including Ukrainian children. The second part of the thesis contextualizes these events within the realm of international law.
