Abstract

Členství ve spolku se sportovním zaměřením Abstrakt Tato diplomová práce zachycuje problematiku členství ve spolku z pohledu platného práva, přičemž analyzuje vnitřní předpisy vydávané samotnými spolky. Cílem práce bylo komplexně představit institut členství ve spolku, jakožto nejčastější právní formy objevující se ve sportovním prostředí. První část práce je věnována obecně právu sdružovacímu, ze kterého spolkové právo vychází, a s ním související problematice dobrovolnosti členství sportovců ve sportovních organizacích. V druhé části práce je představena právní úprava ovlivňující podobu sportovních spolků. Pozornost je zaměřena nejenom na občanský zákoník jako ústřední dokument spolkového práva, ale i na zákon o podpoře sportu a další předpisy. Vedle občanského zákoníku jsou pro spolek významné stanovy, které podobu spolku konkretizují a bez nichž nemůže spolek vůbec fungovat. Důležitou roli ve spolku hrají i jím vydávané vnitřní předpisy, jejichž závaznost však není v zákoně výslovně zakotvena. Membership in the sport association Abstract This thesis deals with the issue of membership in an association from the perspective of the applicable law and analysing the internal regulations issued by the associations themselves. The aim of the thesis is to comprehensively present the matters of membership in an association as the most common legal form active in the sports environment. The first part of the thesis is dedicated to the Right of association, on which the law of association is based. As well as the related issue of voluntary membership of athletes in sports organisations. The legal regulation influencing the form of sports associations is presented in the second part of the thesis. Attention is not focused only on the Civil Code as the leading document of the association law, but also on the Act on the Support of Sport and other regulations. The main association's regulation is the articles of association, which specify the association internal order. The association cannot be in existence without the articles of association at all.
