Abstract

Legal regulation of plant, animal and human health Abstract This diploma thesis is dedicated to the legal regulation ensuring the protection of the health of plants, animals and people. With regard to the current state of sources of health threats, adequate legal regulation is necessary. The legal regulation should ensure and enforce the protection of the health of plants, animals and people, and respond adequately to the development of the state of sources of health threats. The aim of this diploma thesis is to determine and describe the effectivity of the legislation protecting the health of plants, animals and people and in what ways this protection is enforced, and to evaluate the findings. Considering the large number of sources of threats to the health of plants, animals and people, this diploma thesis deals only with these selected sources of threats: diseases, animal infections or harmful organisms; safety of plant protection products, animal feed, food and animal products for the health. The main legal regulations in the theme of this thesis are the Act on Phytosanitary Care, the Veterinary Act and the Act on the Public Health Protection. Zdraví rostlin, zvířat a lidí v právu Abstrakt Tato diplomová práce je věnována problematice právní úpravy zajišťující ochranu zdraví rostlin, zvířat a lidí. S ohledem na aktuální stav zdrojů ohrožení zdraví je třeba adekvátní právní úprava, která bude zajišťovat a prosazovat ochranu zdraví rostlin, zvířat a lidí a která bude odpovídajícím způsobem reagovat na vývoj situace. Cílem této práce je zjistit a popsat, jakým způsobem poskytuje účinná právní úprava ochranu zdraví rostlin, zvířat a lidí a jakými způsoby je tato ochrana prosazována, a vyhodnotit zjištěné poznatky. S přihlédnutím k velkému množství zdrojů ohrožení zdraví rostlin, zvířat a lidí se tato práce věnuje jen těmto vybraným zdrojům ohrožení: onemocnění, nákazy zvířat či škodlivé organismy; bezpečnost přípravků na ochranu rostlin, krmiv, potravin a živočišných produktů. Stěžejními právními předpisy jsou v oblasti zájmu této práce zákon o rostlinolékařské péči, veterinární zákon a zákon o ochraně veřejného zdraví. Práce však neopomíjí ani právní předpisy EU nebo právní úpravu trestných činů v trestním zákoníku. Práce reflektuje právní stav ke dni 24. prosince 2023.
