Teritoriální spory 21. století v kontextu surovinové bezpečnosti

Abstract

Daniel Machytka, Ph.D. Abstract This thesis focuses on the comparison of four selected territorial disputes and on the analysis of their related realities with an emphasis on the strategic importance of these disputed areas. The chosen topics were the territorial dispute between Russia and Japan over the Kuril Islands, the dispute between Argentina and Great Britain over the Falkland Islands, and then two multilateral territorial disputes over the Paracel and Spratly Islands in the South China Sea. This work presents these researched disputes not only from their historical point of view but also with regard to valid international regulations, especially with regard to the rules based on the regulation of the law of the sea, which was adopted in 1982 by the UN Convention on the Law of the Sea. Last but not least, the development of such disputes was studied as close as possible to the present time, when the main time period of the presented research was the period from the beginning of the 21st century. The studied territorial disputes were first analyzed separately and then compared together in order to discover mutual macro-causal connections and key similarities. Daniel Machytka, Ph.D. 1 Abstrakt Tato práce se zaměřuje na srovnání čtyř vybraných teritoriálních sporů a na rozbor jejich souvisejících reálií s důrazem na strategický význam těchto sporných oblastí. Vybranými tématy se stal spor mezi Ruskem a Japonskem o Kurilské ostrovy, dále spor mezi Argentinou a Velkou Británií o Falklandské ostrovy a poté dva multilaterální teritoriální spory o Paracelské a Spratlyho ostrovy v Jihočínském moři. Tyto zkoumané spory práce představuje nejen z jejich historického hlediska, ale tak s ohledem na platné mezinárodní úpravy, obzvláště pak s ohledem na pravidla vycházející z úpravy mořského práva, která byla přijata v roce 1982 Úmluvou OSN o mořském právu. V neposlední řadě byl studován jejich vývoj co možná nejblíže současnosti, kdy hlavní studovanou časovou periodou se stalo období od počátku 21. století. Zkoumané teritoriální spory byly nejprve analyzovány každý zvlášť a posléze byly komparovány dohromady a to za účelem objevení vzájemných makrokauzálních souvislostí a klíčových podobností. Největší podobností je zde konfliktní potenciál, který je patrný z jednání, jaké zainteresované strany využívají k ovládnutí oblasti svého zájmu.
