Abstract

Legal regulation of whistleblowing in Czech Republic Abstract This rigorous thesis addresses the current topic of legal regulation of whistleblowing in the Czech Republic. The aim of this rigorous thesis is to provide a general insight into the issue of whistleblowing. The thesis is divided into five parts, which successively analyse the current state of legal regulation, the history of whistleblowing in the Czech Republic, and its development in an international context, the fundamental problems and challenges associated with the protection of whistleblowers, and finally, a detailed examination of the proposed new law on the protection of whistleblowers in the context of the Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons reporting breaches of Union law. In the introduction, this thesis focuses on the definition of whistleblowing, examines the history of whistleblowing in the Czech Republic and abroad, and discusses the concept of whistleblowing in the legal system. Právní úprava whistleblowingu v České republice Abstrakt Tato rigorózní práce se zabývá aktuálním tématem právní úpravy whistleblowingu v České republice. Cílem této rigorózní práce je poskytnutí obecného vhledu do problematiky whistleblowingu. Práce je strukturována do několika částí, které postupně analyzují současný stav právní úpravy, historii whistleblowingu v České republice a jeho vývoj v mezinárodním kontextu, zásadní problémy a výzvy spojené s ochranou oznamovatelů a nakonec detailně rozebírají návrh nového zákona o ochraně oznamovatelů v kontextu směrnice Evropského parlamentu a Rady (EU) 2019/1937 ze dne 23. října 2019 o ochraně osob, které oznamují porušení práva Unie. V úvodu se tato práce věnuje definici whistleblowingu, zkoumá jeho historii v České republice a v zahraničí a pojednává o zakotvení pojmu whistleblowing v právním řádu. Práce dále představuje hlavní problémy a výzvy spojené s ochranou oznamovatelů v České republice, jako jsou například důsledky marného uplynutí transpoziční lhůty a důsledky z toho plynoucí. Ve stěžejní části práce je popsán současný stav právní úpravy whistleblowingu v České republice. V současné době je zajištěna určitá míra ochrany oznamovatelů prostřednictvím dílčích nástrojů jednotlivých právních odvětví, tato ochrana však neodpovídá požadavkům, které stanovil...
