Abstract

Healthcare Rationing in the Context of Covid-19 Pandemic Abstract This thesis analyses process and means of rationalization of healthcare distribution in Czechia and the impact of covid-19 epidemic on domestic healthcare system and scarce resource allocation. First part of this thesis offers definition of right to healthcare from the constitutional and international legal point of view with the emphasis on obligations stated in the Charter of Fundamental Rights and Freedoms and international charters of human rights, which are binding for Czechia. Second part of this thesis concerns the concept of healthcare rationing, its definition and justification. This part also includes the summary of basic formative criteria of healthcare rationing, which are the imperative of equality and non-discrimination, and furthermore the principles of distributive justice and economic efficiency. This part also deals with the concept of rationing in healthcare in the context of the covid-19 epidemic and the modification of ethical and legal principles of its application during the state of medical emergency. Racionalizace distribuce zdravotních služeb v kontextu pandemie virové choroby covid-19 Abstrakt Tato diplomová práce analyzuje proces a prostředky racionalizace distribuce zdravotních služeb v České republice a dopad epidemie onemocnění covid-19 na tuzemský zdravotní systém a alokaci vzácných zdrojů v českém zdravotnictví. První část práce nabízí ústavněprávní a mezinárodněprávní vymezení subjektivního práva na ochranu zdraví. V rámci této části je kladen důraz na závazky České republiky plynoucí z Listiny základních práv a svobod a mezinárodní katalogy lidských práv, jimiž je Česká republika vázána. Druhá část práce se zabývá konceptem racionalizace poskytování zdravotních služeb, jeho definicí a zdůvodněním jeho účelu. V této části jsou dále vypočtena základní formativní kritéria medicinského rationingu, a to požadavek rovného přístupu a zákazu diskriminace, dále požadavek distributivní spravedlnosti a požadavek ekonomické efektivnosti systému poskytování zdravotní péče. Dále se tato část práce zabývá konceptem rationingu ve zdravotnictví ve světle epidemie onemocnění covid-19 a s tím související modifikací etických a právních východisek pro jeho uplatnění ve stavech medicinské nouze.
