Abstract

European legislation and case law regarding hate crime Author in this work, in accordance with its objective, offers professional and comprehensive view on European legislature and case law regarding hate crimes. For the sake of maximum clarity, the work is divided into four parts. In order to understand and achieve the concept, the first part provides a historical excursion into the issue and the enumeration of European sources related to hate crimes. To achieve aim is for reader to create his/her own opinion on this topic, therefore there is also discussion about prosecution of hate crimes and about their statistical inconsistencies caused by nonuniversal approach. The second part introduces reader to the term of "hate crime" analyzing various definitions, next author provides detailed justified proposal of possible definition of hate crimes with broad list of protected characteristics of potential victims. Unsolicited confusion of the term "hate crime" with related terms is prevented by distinguishing it from similar terms. Particular focus is placed on the specifics of hate crimes, which are relevant to addressing the issue. Európska legislatíva a judikatúra vo veci trestných činov z nenávisti Autorka v tejto práci v súlade s jej cieľom podáva odborný a ucelený výklad k európskej legislatíve a judikatúre týkajúcej sa trestných činov z nenávisti. Za účelom dosiahnutia maximálnej prehľadnosti je práca rozdelená do štyroch častí. Pre lepšie pochopenie konceptu sú v prvej časti poskytnuté historický exkurz do problematiky a vymenovanie európskych prameňov vzťahujúcich sa k trestným činom z nenávisti. S cieľom umožniť čitateľovi vytvoriť si vlastný úsudok o problematike je upozornené aj na stav stíhania trestných činov z nenávisti a na problém nejednotnosti štatistík, zapríčinený absenciou univerzálnej definície konceptu. Druhá časť uvádza čitateľa do pojmu "trestné činy z nenávisti" rozoberajúc jeho rôzne definície, následne i samotná autorka podáva podrobne odôvodnený návrh možného vymedzenia trestných činov z nenávisti so širokým vymenovaním chránených charakteristík prípadných obetí. Nežiadanému zamieňaniu trestných činov z nenávisti a blízkych pojmov je zamedzené prostredníctvom ich odlíšenia od podobných pojmov. Dôraz je venovaný na špecifiká trestných činov z nenávisti, ktoré sú relevantné pre uchopenie problematiky.
