Zásada subsidiarity trestní represe

Abstract

This thesis is a compilation of selected topics related to the principle of subsidiarity of criminal repression as a guiding principle of criminal law. The text of the thesis deals with the historical development of the approach to this principle in the Czech Republic, as well as the current normative anchoring of this principle in the effective criminal legislation. Furthermore, the text pays attention to the general character of this principle, which is manifested by its interpenetration into a number of institutes of criminal law, as well as its clash with other legal principles. In the practical part of the thesis, attention is then focused on the role of the principle of subsidiarity of criminal repression as a corrective to criminal injustice, as well as on the overlaps of this principle in the field of administrative law. This part of the thesis also takes into account the current cases that occur in the public sphere in relation to the principle of subsidiarity of criminal repression. The final part of the thesis compares selected foreign approaches to the principle of subsidiarity of criminal repression. Tato diplomová práce je zpracováním vybraných témat souvisejících se zásadou subsidiarity trestní represe coby vůdčím principem trestního práva. Text práce pojednává o historickém vývoji přístupu k této zásadě na území České republiky, jakož i o současném normativním zakotvení této zásady v účinné trestněprávní úpravě. Dále je v textu věnována pozornost obecnému charakteru této zásady, který se projevuje jejím prozařování do řady institutů trestního práva, jakož i jejím střetáváním se s jinými právními zásadami. V praktické části práce je pak pozornost soustředěna na roli zásady subsidiarity trestní represe coby korektivu trestního bezpráví, jakož i na přesahy této zásady v oblasti správního práva. Tato část práce pak rovněž zohledňuje aktuální kauzy, které se v souvislosti se zásadou subsidiarity trestní represe vyskytují ve veřejném prostoru. Závěrečná část práce je srovnáním vybraných zahraničních přístupů k zásadě subsidiarity trestní represe.
