Abstract

v českém jazyce Vybrané otázky právního a sociálního postavení katů v českých zemích od 16. do poloviny 19. století z právněhistorické perspektivy Tato práce si klade za cíl komplexně zpracovat právní a sociální situaci katů a pohodných v českých zemích od 16. do poloviny 19. století. Zvláště pak konkrétní pravidla a omezení, která se na katy vztahovala, vycházející jak z právní úpravy a rozhodnutí veřejné moci, tak z obecné společenské situace a postoje konkrétních lidí. Stejně tak práce popisuje některé mýty a předsudky týkající se katů a srovnává je s realitou. Významným aspektem je pojetí cti a její vliv na každodenní život, jakož i vliv jejího snížení. Důležité jsou rovněž výjimky z jednotlivých pravidel a jejich důvody či možné důvody. Práce těchto cílů dosahuje hlavně metody dedukce a indukce s použitím dobových pramenů a právní úpravy. Dále srovnáním právní úpravy s rozhodnutími veřejné moci a s reálnými případy. Tím je odhaleno, které normy byly dodržovány a které byly spíše překonány sociálními aspekty bezectnosti. Rovněž zde je užito gramatického, historického a komparativního výkladu k určení konkrétního cíle a smyslu právní normy, jakož i důvodu pro její vznik. in English Selected issues of legal and social status of executioners in the Bohemian lands from the 16th to the middle of the 19th century from a legal historical perspective The aim of this thesis is to comprehensively elaborate the legal and social situation of executioners and knackers in the Bohemian lands from the 16th to the middle of the 19th century. In particular, the specific rules and restrictions that applied to executioners, based on the legal regulations and decisions of the public authorities, as well as on the general social situation and the attitude of individual persons. The thesis also describes some myths and prejudices concerning executioners and compares them with reality. An important aspect is the concept of honour and its influence on everyday life, as well as the impact of its reduction. Also important are the exceptions to the various rules and the reasons or possible reasons for those exceptions. The thesis achieves these goals mainly by the method of deduction and induction using historical sources and legal regulations. It also compares the legal regulations with public authorities decisions and real situations. This reveals which norms were followed and which were rather overcome by the social aspects of dishonour.
