Právní úprava činnosti pojišťovacích zprostředkovatelů

Abstract

Právní úprava činnosti pojišťovacích zprostředkovatelů Stěžejní část této diplomové práce se věnuje analýze a zhodnocení nové právní úpravy pojišťovacích zprostředkovatelů obsažené v zákoně č. 170/2018 Sb. o distribuci pojištění a zajištění, která je výsledkem implementace směrnice Evropského parlamentu a Rady 2016/97 do českého právního řádu. Práce je rozdělena do tří kapitol. V první kapitole je poskytnuto seznámení se se segmentem pojišťovnictví jako specifickým ekonomickým odvětvím. Pojednávám zde jak o historii pojišťovnictví a pojištění, tak i o současném stavu. Je zde stručné vymezení pojmu pojišťovnictví a pojištění z právního i ekonomického hlediska. V závěru této kapitoly vymezuji jednotlivé distribuční kanály, mezi které patří i pojišťovací zprostředkovatelé. Druhá kapitola začíná stručným shrnutím vývoje právní úpravy pojišťovacích zprostředkovatelů od vzniku samostatné České republiky do současnosti. Poté tato kapitola pokračuje rozdělením a rozborem jednotlivých kategorií pojišťovacích zprostředkovatelů a podmínky pro udělení oprávnění ke zprostředkovatelské činnosti v daných kategoriích. Legal regulation of activities of insurance intermediaries Main part of this diploma thesis is aimed at the analysis and evaluation of new national regulation of insurance intermediaries included in the Act no. 170/2018 on distribution of insurance and reinsurance which is the result of implementation of Directive 2016/97 on insurance distribution into the national legislation. This thesis is divided into three chapters The first chapter is dedicated to the introduction of insurance industry as its own and specific economic segment. In this chapter I am discussing insurance industry from both historic and contemporary point of view. I try to briefly define insurance and insurance industry both from legal and economic aspects and then describe development of insurance and insurance industry through the history. At the end of this chapter, I discuss different distribution channels in insurance industry as one of those channels are insurance intermediaries. The second chapter starts with summary of historical regulation of insurance intermediaries since the creation of independent Czech Republic to present day.
