Abstract

Název práce, klíčová slova a resumé Trestněprávní aspekty kyberšikany Klíčová slova: kyberkriminalita, kyberšikana, trestní právo Tato diplomová práce se zabývá vymezením klíčových trestněprávních aspektů protiprávního jednání označovaného jako kyberšikana. Diplomová práce je rozdělena do pěti samostatných kapitol. První kapitola pojednává o obecném vymezení kyberšikany jako nového tradiční formou šikany, definuje některé klíčové pojmy a vymezuje oběť i pachatele tohoto jednání, a to včetně jejich druhů a typologie. druhé kapitole je představen kyberstalking, který je po vzoru první kapitoly porovnáván e stalkingem, opět jsou zde vymezeny a definovány základní pojmy, které jsou pro tuto problematiku příznačné, stejně jako pachatel i oběť, s přihlédnutím k jejich vzorcům chování, typologii i motivům, které vedou agresora ke spáchání protiprávního jednání. Třetí kapitola se zaměřuje na nedovolené nakládání s osobními údaji, které může sloužit usnadnění páchání kyberšikany, zároveň je zde všem zmíněn i institut "zamražení dat", jež naproti tomu slouží orgánům činným v trestním řízení jako prostředek vystopování a odhalení pachatele kyberšikany.
