copyright, artificial intelligence, authorshipUmělá inteligence a autorské právo Abstrakt Práce se zabývá vztahem autorského práva a umělé inteligence, jejíž význam v posledních letech neustále roste, a to i v oblasti umění a kreativní činnosti. Hlavní otázkou tohoto konfliktu je, zda mohou být výstupy umělé inteligence autorským dílem, případně kdo je jejich autorem. V první části se práce zabývá dvěma předběžnými otázkami, které je nutné pro zhodnocení hlavní otázky zodpovědět. Nejprve se práce zabývá tím, co to vlastně umělá inteligence je, jak funguje a jaká je její definice. Následně práce posuzuje aktuální právní úpravu, která se vztahuje na umělou inteligenci a její výstupy. V druhé části práce identifikuje českou a unijní právní úpravu autorského díla a jeho pojmových znaků. S tím již souvisí hlavní otázka této práce, tedy zda mohou být tyto pojmové znaky naplněny i výstupy umělé inteligence. Práce k tomuto posouzení používá dva skutečné projekty umělé inteligence z hudebního průmyslu. Největší pozornost je věnována zejména pojmovému znaku tvůrčí činnosti autora, který je pro výstupy umělé inteligence nejvíce problematický. 1 Artificial intelligence and copyright law Abstract This thesis studies the relationship between copyright law and artificial intelligence which is becoming more and more significant even in the field of creative arts. The main question of this ongoing conflict is whether creative outputs of artificial intelligence can be copyrightable works and if so, who is the author of such works. The first part of the thesis deals with the two preliminary questions which must be answered before assessing the main issues of this thesis. Firstly, the thesis answers what artificial intelligence is, how it works and what is its definition. Secondly, current legislation regarding artificial intelligence and its creative outputs is assessed. In the second part the thesis identifies relevant regulation defining conceptual features of copyrightable works in the Czech Republic and the European Union. Main issue of this part is whether outputs of artificial intelligence can fulfill requirements set by the conceptual features of work. Two examples of real artificial intelligence projects from the music industry are used in this analyses.
