judicial deference, administrative practice, statutory constructionVztahy mezi soudy a veřejnou správou při výkladu práva Abstrakt Soudní přezkum správních rozhodnutí (a interpretace práva v nich obsažených) může mít různý standard (přísnost). Klasická kontinentální představa správního soudnictví vychází z teze, že soudy si právní otázky posuzují nezávisle na správním orgánu. Záměrem práce je tuto představu zpochybnit a nastínit okruhy případů, ve kterých lze uvažovat o tom, že by soudy vůči veřejné správě mohly vystupovat zdrženlivě ("deferenčně"), tzn. ponechat správě určitý prostor pro vlastní výklad práva, který soud bude akceptovat, byť by ho sám nemusel nutně považovat za nejsprávnější. Komparativní část práce ukazuje, že takový přístup správních soudů k interpretaci práva učiněné veřejnou správou není zcela ojedinělý. Jedná se zejména o Spojené státy americké, kde se v případě nejasného znění zákona či prováděcího předpisu těší deferenci výklad ze strany příslušného správního úřadu, pokud je tento výklad alespoň rozumný. Také české správní soudy (a Ústavní soud ve správních věcech) často připouštějí, že existuje více srovnatelně přesvědčivých interpretací práva. V takovém případě je podle judikatury nutné - v duchu zásady in dubio pro libertate - přiklonit se naopak ve prospěch výkladu příznivějšího pro adresáta práva. Relations between courts and public administration in statutory construction Abstract Judicial review of administrative decisions (and statutory construction contained in them) may use divergent standards (strictness). The classical continental concept of administrative justice follows from the notion that courts answer questions of law independently of the administrative body. The goal of the thesis is to cast doubt on this concept and to define situations where it can be considered that courts could be deferential towards the public administration, i.e. leave certain space to the administration for its own interpretation, which the court would accept even though the court itself might not see the interpretation as the best one. The comparative part of the thesis shows that such an approach of administrative courts regarding interpretation made by public administration is not totally rare. That is mainly the case of the United States of America, where in the instance of ambiguous statutes or secondary legislation, the interpretation made by the agency charged with administering the law is rewarded with deference if such interpretation is at least permissible.
