Interpretation of labour law regulations, case law, The Supreme Court of the Czech RepublicVýklad pracovněprávních předpisů v judikatuře Nejvyššího soudu ČR Abstrakt Předmětem zkoumání této práce je osm rozhodnutí Nejvyššího soudu, které byly vybrány pro svou mimořádnou relevanci v pracovním právu. Interpretační otázky řešené Nejvyšším soudem v jednotlivých případech jsou nejprve autorem práce interpretovány, následně jsou autorovy interpretační závěry porovnávány se závěry Nejvyššího soudu a je hodnocena správnost těchto závěrů včetně správnosti užité metodiky. K analýze v rámci této práce byly vybrány rozsudky rozsudky sp. zn. 21 Cdo 4986/2010, 21 Cdo 224/2013, 21 Cdo 2745/2013, 21 Cdo 385/2014, 21 Cdo 5433/2014, 21 Cdo 3240/2015, 21 Cdo 1276/2016 a 21 Cdo 1276/2016. Jednotlivé rozsudky se zabývají problematikou výpovědi konkurenční doložky, povinnými náležitostmi lékařského posudku v kontextu jeho užití jako podkladu pro dání výpovědi zaměstnavatelem, kolizí mezi překážkou v práci na straně zaměstnavatele a překážkou v práci na straně zaměstnance v případě vedoucího zaměstnance odvolaného z funkce a následně dlouhodobě uvolněného pro výkon veřejné funkce, charakterem plnění poskytnutého zaměstnavatelem zaměstnanci na úhradu pokuty udělené během výkonu práce, vztahem mezi nárokem na odstupné a obdrženou kompenzací podle § 44b Zákona o zaměstnanosti, přípustností výpovědi v případě naplnění...
Interpretation of labour law regulations in the case law of The Supreme Court of the Czech Republic Abstract This thesis examines eight rulings of The Supreme Court of the Czech Republic that were handpicked for their extraordinary relevance in labour law. The author of this thesis attempts to find the solution to the problems solved by The Supreme Court in these rulings and then compares his reasoning and conclusions with the ones provided by The Supreme Court while evaluating the validity of the court's reasoning and conclusions along with whether The Supreme Court found its conclusions in a methodically sound manner. Rulings of cases No. 21 Cdo 4986/2010, 21 Cdo 224/2013, 21 Cdo 2745/2013, 21 Cdo 385/2014, 21 Cdo 5433/2014, 21 Cdo 3240/2015, 21 Cdo 1276/2016 and 21 Cdo 1276/2016 were the ones selected for analysis.
