provisional measures, interim measures, human rights protectionPředběžná opatření v oblasti mezinárodního práva lidských práv Abstrakt V případě ohrožení lidských práv by měla následovat rychlá reakce autority, která se případem zabývá. Předběžná opatření mohou být užitečným nástrojem, jak nenapravitelné újmě na lidských právech zabránit. Cílem rigorózní práce je navázat na autorčinu diplomovu práci a zanalyzovat předběžná opatření uplatňovaná soudními a kvazisoudními orgány zabývajícími se na různých kontinentech lidskoprávními případy. Hlavní důraz je kladen na právní základy, které mezinárodním fórům umožňují ukládání předběžných opatření, odpověď na otázku, zda jsou uložená předběžná opatření právně závazná, zhodnocení míry, do jaké orgány tento institut využívají, uvedení příkladů typických situací, kdy jsou předběžná opatření uplatňována a zhodnocení, zda lze nalézt data ohledně míry dodržování předběžných opatření ze strany států. Metodou práce je analýza s komparativními prvky. Rigorózní práce je členěna do šesti kapitol. První kapitola je úvodní a definuje pojem předběžných opatření, jejich hlavní charakteristiky a podmínky pro jejich ukládání. Druhá až pátá kapitola se zabývají soudy a kvazisoudními orgány na univerzální úrovni a v Evropě, Africe a obou Amerikách. Provisional Measures in International Human Rights Law Abstract Whenever human rights are at stake there should be quick response of the authority dealing with the situation. Provisional measures can therefore be useful tool how to prevent irreparable harm. The aim of my rigorous thesis is to complement my diploma thesis and to analyse provisional measures indicated by various human rights adjudicators from different continents. Main focus is put on legal provisions empowering international courts and quasi- judicial organs to indicate provisional measures, examining whether provisional measures are legally binding, exploring the extent to which international forums indicate provisional measures, highlighting some specific types of provisional measures and examining whether we can answer the question whether addressees do implement issued provisional measures in proper manner. The approach is description with elements of comparison. The thesis is composed of six chapters. Chapter one is introductory and defines the concept of provisional measures and its main characteristics and conditions for use.
