Prekážky v súťaži o verejné zákazky (prípad Informačného systému pre dohľad nad hazardnými hrami)

Abstract

This bachelor thesis discusses obstacles in the procedures of pre-tendering and tendering phases of public procurement. The thesis is a case-study, that works with a specific public contract under the name of "Supply and implementation of Information system for the supervision of gambling". The thesis aims to clarify the process of public procurement and point out the obstacles and weak spots in the system, which cause delays or abolitions of public contracts. It does so with the help of dividing the process into phases according to the work of Langr and Ochrana "Systemic Corruption in Public Procurement" (2015). The research is based on the information from the official reports of the public tender, information from relevant respondents taking part in public procurement and draws from scientific literature and previous researches. Last, but not least, the thesis tests the theory of "Factors Affecting the Length of Procedure in Public Procurement" by Plaček, Schmidt, Ochrana et al. (2019), which presents four factors affecting delays. The thesis confirms the theory and assigns each factor with obstacle that causes a delay.

Táto bakalárska práca sa zaoberá prekážkami v procesoch zadávania a súťaženia o verejné zákazky. Práca je prípadovou štúdiou, ktorá pracuje s konkrétnou verejnou zákazkou pod názvom "Dodávka a implementace Informačního systému pro dohled nad hazardními hrami". Práca si ukladá za cieľ objasniť čitateľovi proces verejného obstarávania a poukázať na prekážky a slabé miesta v systéme, ktoré spôsobujú predĺženia či zrušenia verejných zákaziek. Robí tak pomocou rozdelenia procesu obstarávania do fáz podľa práce Langra a Ochranu "Systemic Corruption in Public Procurement" (2015). Výskum vychádza z informácií z oficiálnych záznamov o zákazke, z informácií od relevantných respondentov podieľajúcich sa na verejnom obstarávaní a taktiež čerpá z odbornej literatúry a predošlých výskumov. V neposlednom rade sa výskum opiera o teóriu z práce "Factors Affecting the Length of Procedure in Public Procurement" od Plačka, Schmidta, Ochranu a spol. (2019), na základe ktorej testuje štyri faktory predĺžení. Práca teóriu potvrdzuje a k jednotlivým faktorom priraďuje konkrétne prekážky spôsobujúce predĺženia.
