Abstract

Problematika výživného mezi rodiči a dětmi (srovnávací studie) Tato diplomová práce se zabývá problematikou výživného mezi rodiči a dětmi. Výživné je tradičním institutem občanského práva, který se systematicky řadí do rodinného práva. Rodinné právo se obecně více či méně dotýká každodenního života jedince ve společnosti. Problematika výživného je téma aktuální a neustále se vyvíjející, kterému je ve společnosti tradičně věnována značná pozornost. Specifický druh výživného, a sice výživné mezi rodiči a dětmi pak představuje z hlediska četnosti nejrozšířenější druh výživného, který se ve společnosti uplatňuje, zejména pokud se týká vyživovací povinnosti rodičů k dětem. Je tedy možné konstatovat, že výživné je právním institutem, který není předmětem zájmu pouze právnické veřejnosti, ale je tématem, které bývá diskutováno a bedlivě sledováno v rámci celé společnosti. Tato diplomová práce je pojata jako srovnávací studie, právní úprava České republiky je napříč diplomovou prací porovnávána s právní úpravou Spolkové republiky Německo. The maintenance is a traditional institute of civil law, which systematically belongs to family law. The family law concerns in general way more or less an everyday life of individual in society. The issues of maintenance are current and constantly developing topic, which the society pays traditionally significant attention to. The specific type of maintenance that is maintenance between parents and children represents from the point of frequency the most widespread type of maintenance, which is exercised in the society, especially as regards maintenance obligation of parents to children.
