Abstract

Manželství ve srovnání s nesezdaným partnerstvím Abstrakt Cílem předkládané práce je zejména porovnat manželství a nesezdané partnerství z pohledu českého rodinného práva. Tato práce je rozdělena do sedmi částí, dále obsahuje úvod a závěr. První část je věnována charakteristice pojmů. V první kapitole je charakterizován pojem "rodina" - je rozebrána judikatura ESLP a ESD týkající se práva na rodinný život a práva na soukromý život. Pojem "rodina" je dále charakterizován z pohledu odborné literatury a ze sociologického pohledu. Kapitola první přibližuje i historický vývoj rodiny a současné pojetí rodiny. Druhá kapitola se charakterizuje pojmy "manželství" a "nesezdané partnerství", třetí kapitola přibližuje vývoj rodinného práva. Druhá část se zaměřuje na vznik manželství a nesezdaného partnerství. První kapitola přibližuje historický vývoj vzniku manželství a nesezdaného partnerství, v druhé kapitole je porovnáván vznik manželství a nesezdaného partnerství, ve třetí kapitole jsou porovnávány následky vzniku manželství a nesezdaného partnerství a čtvrtá kapitola se věnuje zdánlivosti a neplatnosti. Třetí část je věnována povinnostem a právům manželů a nesezdaných partnerů. V první kapitole jsou porovnávány osobní a majetkové povinnosti a práva manželů a nesezdaných partnerů, v druhé kapitole jsou porovnávány...

Marriage compared to unmarried cohabitation Abstract The purpose of my thesis is to compare a marriage and an unmarried cohabitation from the point of view of the family law of the Czech republic. Besides introduction and conclusion, this thesis consist of seven parts. The first part characterizes terms. The first chapter describes the term "family" - the first chapter analyzes the case law of the European Court of Human Rights and the case law of the European Court of Justice related to the right to family life and the right to privacy. The term "family" is further characterized by the professional literature and by the sociologist. The first chapter describes the historical evolution of the family and the current concept of the family.
