Abstract

Ochranné léčení a zabezpečovací detence Abstrakt Tématem této diplomové práce jsou dvě ochranná opatření - ochranné léčení a zabezpečovací detence. Jedná se o trestněprávní sankce, které představují právní následky trestného činu či činu jinak trestného. Jejich funkcí je léčba, náprava pachatele a ochrana společnosti před nebezpečnými osobami. Vzhledem k množství případů z nedávné doby, kdy se duševně nemocní pachatelé dopustili závažného násilného jednání po propuštění či útěku z ochranného léčení, jde o aktuální téma. Cílem této práce je charakteristika ochranných opatření obecně a dále podrobný rozbor jednotlivých aspektů ochranného léčení a zabezpečovací detence, tedy jejich ukládání, výkonu, trvání, změny a ukončení. V případě ochranného léčení také charakterizuji jeho formy a typy. Analýzou účinné právní úpravy zhodnotím tato ochranná opatření z hlediska de lege lata a také navrhnu možná opatření de lege ferenda. V úvodních kapitolách charakterizuji pojem a účel ochranných opatření, přičemž je také srovnám s tresty. Ve stručnosti popisuji i zabrání věci, zabrání části majetku a ochrannou výchovu. Následně definuji důležité pojmy, se kterými ochranná opatření pracují, např. pojem nepříčetnosti, zmenšené příčetnosti či zneužívání návykových látek. Protective treatment and security detention Abstract The topic of this diploma thesis is two protective measures - protective treatment and security detention. This is a criminal sanction which is legal consequences crime or other offense. Their function is treatment, rectification of the perpetrator and protection of the company against dangerous persons. Due to the number of recent cases when mentally ill offenders commit serious acts of violence after release or escape from protective treatment, is a topical topic. The aim of this thesis is the characterization of protective measures in general and a detailed analysis of the individual aspects of protective treatment and security detention, their storage, performance, duration, change and termination. In the case of protective treatment, I also characterize its forms and types. By analyzing effective regulation, I will evaluate these safeguards in terms of de lege lata and also propose possible measures de lege ferenda.
