Nezávislost a nestrannost Arbitrážního soudu pro sport v kontextu případu Pechstein

Abstract

Title: Independence and impartiality of the Court of Arbitration for sport in the context of the Pechstein case Objectives: The main objective of this bachelor thesis is to identify a structural imbalance in the Court of arbitration for sport and to devise some suggestions for a new reform of CAS. Methods: This thesis used the method of analysis of the secondary data from documents of various formats, specifically different variants of web resources and books. Results: I have found that the Court of arbitration for sport has several structural imbalances in these parts: Independence of ICAS, Independence of individual arbitrators, Information on arbitrators, Publication of CAS awards, Publication of administrative documents and Access to justice. Název: Nezávislost a nestrannost Arbitrážního soudu pro sport v kontextu případu Pechstein Cíle: Hlavním cílem této práce je identifikace strukturálních nedostatků Mezinárodní sportovní arbitráže a navržení doporučení pro její novou reformu. Metody: V práci jsem využila metodu retrospektivní analýzy sekundárních dat, konkrétně studium dokumentů z elektronických zdrojů a tištěné literatury. Výsledky: Zjistila jsem, že Mezinárodní sportovní arbitráž vykazuje hned několik strukturálních nedostatků v následujících oblastech: oblast nezávislosti ICAS, nezávislosti jednotlivých rozhodců, transparentnosti informací o rozhodcích, zveřejňování výsledků řízení CAS, zveřejňování správních dokumentů CAS a přístupu ke spravedlnosti. Pro dané oblasti jsem navrhla celkem 8 doporučení eliminujících podjatost CAS. Klíčová slova: nezávislost, nestrannost, kauza Pechstein, Mezinárodní sportovní arbitráž
